Product Warranty

GENERAL WARRANTY. Aquastone Graphic Arts & Print guarantees (Company) this Product against defects in workmanship and materials, under normal use and proper assembly, for a period of one (1) year from date of purchase. The company’s obligation under this agreement is limited solely to repair or replacement by Company at the Company’s option, during the warranty period.

This Warranty may not be modified or extended without explicit authorization from the Company. The General Warranty applies to the original owner only and must have been purchased from an “Aquastone Graphic Arts & Print”. To file a claim an original receipt must be provided. THIS WARRANTY SHALL IMMEDIATELY TERMINATE IF THE PRODUCT OR COMPONENTS

THEREOF, ARE SUBJECT TO ACCIDENT, ALTERATIONS, ABUSE OR MISUSE, IMPROPER INSTALLATION OR OPERATION, NEGLECT OR IMPROPER MAINTENANCE, DIRECTLY OR INDIRECTLY CAUSING SUCH DEFECT.

The company is not responsible for labor charges, installation, or other incidental or consequential costs. In no event shall the liability of the Company exceed the purchase price of the product. Proof of purchase (original sales receipt) must be provided to

A company with all warranty claims.

DISCLAIMER.

ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE AND ALL OTHER WARRANTIES AND REPRESENTATIONS, EXPRESSED OR IMPLIED, ARE HEREBY DISCLAIMED AND EXCLUDED BY THIS AGREEMENT. THERE IS NO WARRANTY WHICH EXTENDS BEYOND THE DESCRIPTION CONTAINED HEREIN. NO WHOLESALER, DISTRIBUTOR, RETAILER, ANY AGENT OF THE COMPANY MAY ALTER OR AMEND SECTIONS OF THIS WARRANTY WITHOUT THE PRIOR AUTHORIZATION OF THE COMPANY. CUSTOMER WAIVES THE BENEFIT OF ANY RULE THAT DISCLAIMER OF WARRANTY SHALL BE CONSTRUED AGAINST COMPANY.

LIMITATION OF LIABILITY.

The company does not assume or authorize any person to assume for Company any liability or obligations in connection with the Product. Company’s liability does not include any special, consequential, incidental or resulting damage to persons, property, equipment, goods, merchandise, profits, goodwill or reputation arising out of any defect in or failure of the Company’s Product. All warranty policies are limited to the sale of Products within the U.S. Repairs and/or replacement by Company is the sole and exclusive remedy for Customers and any damages for breach of the Warranty are strictly limited to the amount paid by Customer for the Product found to be defective. This warranty is applicable to the original purchase by the end-user only and may not be transferred, acquired, or assigned.

FILING A CLAIM.

If you believe that you have a warranty claim, contact info@aquastone.us. Please be sure to provide all pertinent information regarding your claim, including a complete description of the problem, the product, model number, color, finish, the date the product was purchased and from whom the product was purchased. Proof of purchase (original sales receipt) must be provided to the Company with all warranty claims. Your claim will be addressed on the next business day Monday – Friday, holidays excluded. If the Company is excluded from repair remedy for Product, Company is not liable for any associated costs that were not preapproved by Company.

AQUASTONE GRAPHIX, LLC LIFETIME STRUCTURAL WARRANTY – Applicable only to products purchased after 1/1/2017. Aquastone Graphix, LLC (dba) Aquastone Graphic Arts & Print, LLC (“Company”) guarantees this Product against structural defects, under normal use and proper assembly, for the lifetime of the product. The company’s obligation under this agreement is limited solely to product repair or product replacement by Company at the Company’s option, during the warranty period. The Structural Warranty applies to the original owner only and must have been purchased from an “Aquastone Graphic Arts & Print”. To file a claim an original receipt must be provided. This Warranty may not be modified or extended without explicit authorization from the Company. Company’s warranties herein apply only to Customer and do not extend, expressly or by implication, to any other person or entity, unless required by law. THIS WARRANTY SHALL IMMEDIATELY TERMINATE IF THE PRODUCT, OR COMPONENTS THEREOF, ARE SUBJECT TO ACCIDENT, ALTERATIONS, ABUSE OR MISUSE, IMPROPER INSTALLATION OR OPERATION, NEGLECT OR IMPROPER MAINTENANCE, DIRECTLY OR INDIRECTLY CAUSING SUCH DEFECT.

What is typically not covered under a Structural warranty?

1. Surface rust that does not hinder the function of the product.

2. Paint damage that could lead to surface rust damage (e.g., stone chips, scratches).

3. Acts of nature, improper use, faulty installation, or any alteration/modification to the installed location that could be reasonably expected to affect the performance of the structural and finish components.

4. Environmental pollution or conditions, including acid rain, hail, or lightning.

5. Neglect, abuse, vandalism, or use of the installed location for unintended purposes.

6. Fading, corrosion, or rust as a result of exposure to the outdoors (i.e.; sprinklers).

7. Cleaning and polishing agents, chemicals, and solvents, including improper use of other rust prevention materials.

Some states/provinces do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of special, incidental, or consequential damages, so these limitations and exclusions may not apply to you. This warranty gives the consumer specific legal rights. You may also have other rights, which vary, from state/province to state/province. This warranty is to the original consumer purchaser only and excludes product damage due to installation error, product abuse, or product misuse, whether performed by a contractor, service company, or the consumer.

Installation Protection Warranty

Aquastone Graphic Arts & Print (Independent Contractor) 1-Year Limited Installation Warranty

WHAT IS COVERED BY THE INSTALLATION WARRANTY

In addition to any warranty extended to the customer directly from the supplier/manufacturer of the product or materials used in the installation, the independent contractor will separately warrant that all of its work substantially conforms to the manufacturer’s recommendations and follows industry standards and quality guidelines and that, upon notice from customer, it will correct any faults related to defective workmanship or misapplication of the product at no additional cost to the customer. Should the independent contractor fail to honor its installation warranty, for a period of one (1) year from the date of substantial completion of the work, upon notice to Aquastone Graphic Arts & Print and only if the work is determined to have been performed in a manner inconsistent with industry standards, Aquastone Graphic Arts & Print will assist in the resolution of such defective work. If the warranty work requires the replacement of a product that is no longer available, the customer agrees to accept a reasonable product match.

WHAT IS NOT COVERED

This Limited Installation Warranty does not cover the following items:

Any installation defect that was apparent or ascertainable at the time the work was completed but was not promptly reported to Aquastone Graphic Arts & Print;

Damage related to subsequent alterations, misuse or abuse of the covered items by any person other than the independent contractor;

Damage resulting from fires, storms, electrical malfunctions, accidents, floods, sub-grade moisture conditions, leaks or acts of God;

Damage related to customer’s failure to observe any instructions from the independent contractor and/or requirements of the manufacturer with respect to the product, including without limitation failure to control humidity and temperature levels within the home;

REMEDIES AND LIMITATIONS

The customer understands that the customer must first make all reasonable efforts to compel the independent contractor to honor its warranty before contacting Aquastone Graphic Arts & Print. The preferred remedy is always for the repair or re-installation to be completed by the original installer whenever possible.

With respect to any claim asserted by the customer against Aquastone Graphic Arts & Print, the customer understands that the customer will have no right to recover or request compensation for, and Aquastone Graphic Arts & Print shall not be liable for, any of the following items:

• Incidental, consequential, secondary, or punitive damages;

• Damages for aggravation, mental anguish, emotional distress, or pain and suffering;

• Costs in excess of the total contract amount for the project; or

• Attorney’s fees or costs.

Aquastone Graphic Arts & Print makes no other warranty, express or implied, other than as set forth herein;

These limitations shall be enforceable to the extent permitted by law.

HOW TO OBTAIN SERVICE

If a problem with the installation develops during the warranty period, after first attempting to get the independent contractor to remedy the problem, the customer should contact Aquastone Graphic Arts & Print at 1 (860) 206-4935 or provide written notice to Aquastone Graphic Arts & Print at the following address:

The written notice should include the following information: the customer’s name, address, and telephone numbers, and a description of the nature of the problem. Aquastone Graphic Arts & Print will investigate the claim promptly. Any warranty work will be done during normal working hours except where a delay will cause additional damage. The customer agrees to provide access to the house and to make available during the work a responsible adult with the authority to approve the warranty work and confirm satisfactory completion of the warranty work.

Aquastone Graphic Arts & Print IS NOT A GENERAL CONTRACTOR NOR DOES IT PROVIDE CONTRACTING SERVICES.

The independent contractor is responsible for the performance of any work pursuant to a contract between the independent contractor and the customer and the fulfillment of any and all warranties provided to the customer by the independent contractor.

VOIDED WARRANTY:

This Limited Installation Warranty is voided under the following circumstances: The work is not included in the Project Description on the Aquastone Graphic Arts & Print Completion Certificate or Invoice; the customer has signed the Aquastone Graphic Arts & Print Completion Certificate or Invoice but has not made the final payment for the project.

COMPLETE AGREEMENT:

The customer acknowledges that this Limited Installation Warranty constitutes the entire agreement between the parties and that NO representation, whether oral or in writing, shall in any way alter the terms of this Limited Warranty. Furthermore, nothing in this Limited Warranty shall in any way restrict the right of the independent contractor to bring action against the customer for non-payment.
